Introduction In The Ever Smart, the Supreme Court construed the Collision Regulations and said the crossing rules were to be strictly applied. However, in subsequent decisions that strict approach has already been tested. This seminar will consider those decisions.
Specific issues for discussion:
Departing from the strict approach: “compelling necessity”, and to what extent can the crossing rules be “moulded” by circumstances?
The “conundrum” of the stand-on vessel that caused the ships to cross.
When are ships in a head on situation?
Who should resolve all these uncertainties: the judge or the nautical assessors?
How should decisions in the courts be conveyed to mariners?
And hear how it all works in practice from a working pilot.
