Marine soil investigation at Tuas West Coast

From 2 April through to 31 July, marine soil investigation works are being carried out at Tuas West Coast.

A jack-up barge is being used to carry out the soil investigation work. Movement of the jack-up barge is assisted by tug and during daylight hours only. The jack-up barge is held in place by steel legs anchored into the seabed.
A safety boat is deployed in the vicinity to warn other craft about the works.
Craft involved in the works exhibit the appropriate local and international day and night signals.
When in the vicinity of the working area, mariners are reminded to:
a) Keep well clear and not to enter the working area;
b) Maintain a proper lookout;
c) Proceed at a safe speed and navigate with caution;
d) Maintain a listening watch on VHF Channel 22 (Jurong Control);
and
e) Communicate with Jurong Control for assistance, if required.

Disinfection of vessel accommodation

Istanbul’s Harbour Master Authority has announced that accommodation places of vessels calling at ports in the Istanbul region must be disinfected by the companies authorised Ministry of Health via vessel agencies.

Heightened security at ports during lockdown

Maritime Security Protocols for the South African Ports have been raised with immediate effect. This means that a heightened level of security protocols are to be observed within the ports.
The following measures will be implemented with immediate effect until further notice:
The Declaration of Security (DoS) must be completed by the vessel and sent to the Agent to be uploaded onto the Integrated Port Management System (IPMS). The vessel will not be cleared in terms the International Ship and Port Facility Security ISPS) on the IPMS, and therefore cannot berth until this document is received by TNPA security.
Vessels are to operate on Maritime Security Level 2 (MARSEC)
Stowaway search shall not be done by a local service provider. The search must be done by the crew and the search documents emailed to TNPA security after departure.
PSIRA registered Security Officers may be placed on the wharf-side of the vessel for the entire port stay, however no boarding of the vessel will be permitted without Port Security Officer (PSO) approval.
The above measures are intended to ensure that no persons other than the surveyors and stevedores who are essential workers may board the vessel. The whole objective is to eliminate any exposure to South African citizens with regards to COVID-19.
The gangway register of all persons that boarded the vessel must be emailed to TNPA security after the vessel has sailed.
Persons requiring access to vessels (Law Enforcement Agencies and/or any authorized person in terms of the applicable directives) will be required to report to the permit office on arrival at the port to sign in the Vessel Access Register for record purposes.
Cash to Master operations may be conducted, however no physical contact or boarding of vessel is permitted for this. A lockable receptacle must be placed on the quayside and hoisted onboard. All associated administrative process are to be electronically engineered.
No crew changes are allowed at all South African commercial ports.
No passengers may embark or disembark at all South African commercial ports.
If the gangway is not in use it must be raised.
Port users are urged to bring their own masks and gloves as an additional precautionary measure.
For all Port users whose permits have expired, they must present themselves to the PSO who will render assistance. Kindly note that no new permit applications will be entertained.
TNPA Security Management would like to urge all port users to maintain high levels of security within their respective areas and to continue with the following precautionary measures:
Consistently disinfect working surfaces
Use of sanitizers
Frequent washing of hands; and
Avoid close contact with other people.
TNPA Security Management would furthermore like to emphasize to all port users the seriousness of any breach of security and the severe consequences associated with such actions as per Section 37 of the Merchant Shipping (Maritime Security) Regulations, 2004 and the Convid-19 Regulations as contained in Government Gazette No.43103 dated 18 March 2020 and Government Gazette No.43148 dated 25 March 2020, as amended.

Suspension of flights extended

The Government of Pakistan has decided to extend the suspension of all inbound international passenger, chartered and private aircraft, as well as domestic scheduled/non-scheduled, chartered, private aircraft and general aviation operations up to 2359 hours local time on 11 April.
For international flights, exceptions will be made for diplomatic, special/cargo flights and flights of the national carrier to/from Pakistan with special approval from the competent authority to transport stranded passengers. However, passengers onboard inbound flights shall be subject to thorough checking as per established procedures including screening, swab testing and isolation/quarantine as per the advice of the health professionals.
For domestic flights, exemptions will be made for cargo and special flights subject to necessary clearance. Domestic flight operations to/from Islamabad International Airport for Gilgit Airport and Skardu Airport will continue as normal.

Refusal to land to prevent spread of COVID-19

Japan’s Covid-19 Measures Headquarters has announced that, for the time being, the Ministry of Justice that foreign nationals in the following categories will be denied landing, unless in special exceptional circumstances:

Foreign nationals who departed from Japan with re-entry permission on or after April 3, even if they have one of the abovementioned statuses of residence are, in principle, subject to refusal of landing without special exceptional circumstances.
Special permanent residents are not subject to the examination under Article 5, paragraph (1) of the Immigration Control Act and therefore landing will not be denied based on the abovementioned measures.

Second port clearing exercise to expedite movement of cargo

The Malaysian Ministry of Transport has agreed after consultation with the National Security Council to allow freight forwarders and hauliers another four (4) days to expedite the movement of cargo from congested ports nationwide, starting Saturday, 4 April 2020.
Companies whose goods are stored at Port Klang, ports in Johor, Penang, Kuantan, Melaka, Bintulu, Sarawak and Padang Besar bordering Thailand are advised to move their goods out of those ports from Saturday, 4 April 2020 to Tuesday, 7 April 2020.
This follows an earlier decision announced on 26 March 2020, which had proven effective in greatly reducing near 100% congestion at major ports nationwide.
However, to ensure the smooth and continued flow of much-needed daily essentials for households, it has been proven necessary to conduct these port clearing exercises from time to time to allow companies to expedite the movement of their cargo.
This exercise ensures that essential goods are delivered unhampered to the communities that need them in the second phase of the Movement Control Order, which is in effect from 1-14 April 2020.
Based on the positive response shown by the Ministry’s allowance to federal ports, state-owned ports including those in Sabah and Sarawak have proceeded to allow companies to expedite their goods out of their respective ports to reduce congestion and ensure essential goods reach their intended destinations. The Ministry has shared its standard operating procedures to those ports and those in foreign countries that had requested it.
This latest port clearing exercise is in line with the Prevention and Control of Infectious Diseases Act 1988 (Measures within the Infected Local Areas) (No. 2) Regulations 2020 which takes effect during the EMCO from 1 to 14 April 2020.
Pursuant to the amendments made to Regulations No.2, port, dock and airport services and undertakings, and transportation by land, water, or air constitute essential services. This means that any activity and process in the supply chain of port, dock and airport services and undertaking and transportation by land, water or air are also deemed as essential services.

Guidelines for extension certificates for seafarers

The Federal Transport Authority (FTA) decided to consider that expired certificates related to certificates of competency, certificate of proficiency, other certificates issued to seafarers, medical certificates, and endorsements attesting recognition of certificates in accordance with the STCW Convention 1978, as amended, valid for a period of 3 months, starting from 3/26/2020.
In addition, FTA will work within the port state control system on ships to which the STCW Convention applies, and will take practical approach regarding inspection of all seafarers’ certificates, and consider all extensions on these certificates and its endorsements is acceptable when exercising control procedures in accordance with Article X (and Regulation 1/4) (Control Procedures) of the STCW of 1978, as amended.

Workers leave port after supervisor tests positive

Operations were disrupted at Haldia Docks this morning (3 April) when all workers who arrived in the morning decided not to work and left after learning that a supervisor had tested positive for COVID-19.
All operations at HDC are at a complete standstill. Vessels completed at HOJ are waiting for the outbound pilot and it is not known exactly when they will be moved out.
No work is currently going on inside the port premises. Further progress will be known only as the situation develops.

Police movement ban impact on port formalities

Cargo and vessel clearance formalities at the Port of Kandla have today (3 April) been impacted by local police authorities not allowing people to move around between the hours of 1100 and 1700 hours, in a move to avoid community transmission due to COVID-19.
This has affected the movements of shipping staff who move around for various cargo and vessel related clearance formalities.
After taking this up, the District Administration has confirmed port operations and related transportation activities to be permitted as normal and not interrupted by any means. Cargo dispatch from storage terminals will resume on the basis of this.

Suspension of port operations

Disinfection of arriving vessels

All vessels arriving at Samsun Port on the northeast coast of Turkey must be disinfected at the anchorage area before berthing at the terminal, as part of the COVID-19 preventative measures in force.
The disinfection cost as follows:
– Vessels of 0-5000 GRT: USD 290
– 5001-10000 GRT: USD 480
– 10001-15000 GRT: USD 640
– 15001 GRT and above: USD 910
If a vessel stays over 14 days at the terminal, a second disinfection must be carried out.

Extension of Movement Control Order, impact on shipping

The Government of Malaysia has extended the Movement Control Order (MCO) until 14th of April.
SIGN-OFF
1. All seafarers are ALLOWED to carry out crew change activities (sign-off) in any Malaysia port, subject that the seafarer:
a) in need of a medical evacuation;
or
b) Malaysian citizenship who has completed his/her term of service in accordance to his/her Seafarer Employment Agreement (SEA);
or
c) medically unfit to continue his service due to his physical condition, health (including mental health) or other criteria as determined by the Director of Marine;
or
d) has developed explicit COVID-19 symptoms.
2. A seafarer who falls under the criteria of paragraph 1(b), SHALL comply with the following:
a) Has been declared by the ship’s Master to be in good health at least for the last 14 days;
and
b) The ship has not made any crew change activity at least for the last 14 days.
3. ALL of the ship’s personnel SHALL be subjected to a health screening by the Port Health Officer (PHO) prior to any Malaysian seafarer wishing to sign off due to the circumstances stated in paragraph 1(b), 1(c), or 1(d) if he/she is currently serving on board
a) a foreign-flagged ship;
or
b) a ship that has departed or transitted within the past 14 days from any countries that have been declared at risk by the Ministry of Health Malaysia (MOH).
4. A seafarer who is signing-off due to the circumstances stated in paragraph 1(b), 1(c), or 1(d), SHALL undergo a health screening and be subjected to any further instructions from the PHO.
5. For medical evacuation initial information; shipowner, Master, or agent, may contact Maritime Communication Centre (PUSKOM) at +603-3169-5233/5201 to arrange for a suitable evacuation port.
SIGN-ON
6. For any crew-change activities due to the circumstances stated in paragraph (1), the replacement crew (sign-on) is ONLY PERMITTED for:
a) Malaysian citizenship seafarer with valid seafarer’s identity document, discharge book, and Certificate of Competency (officers);
and
b) Undergo a health screening at port and cleared by the PHO prior to signing-on.
7. Master SHALL perform a daily COVID-19 symptoms monitoring and temperature-checking to all newly-joined crew for at least 14 consecutive days after joining. Master is also encouraged to continuously monitor and keep the health record of the crew.
8. In order to maintain social distancing protocol, the maximum allowable industrial personnel on board at any time for a crewboat shall be limited to 70% of the maximum permissible number.
9. Regardless of any type of ships, strict social distancing protocol according to the MOH guidelines SHALL be practised by ALL newly-joined crew at least for 14 consecutive days after joining. These shall include, but not limited to, providing the newly-joined crew an individual and separate accommodation.
TRAVEL PERMIT
10. For the purpose of a supporting letter to apply for a Travel Permit to the Port of Embarkation, seafarers shall provide the following documents:
a) Letter of Employment;
b) Company confirmation stating the name of ship, port of registry, and port of embarkation of the seafarer;
c) Particulars of home address;
d) Expected traveling and sign-on date;
e) Valid seafarer documentation;
f) Health Declaration.
Documents shall be submitted via email to the dedicated Port Office.
SEAFARER DOCUMENTATION
11. SEA which expires during the period of MCO may apply for an extension of one (1) month, as long as the total period of the SEA including the extension is not more than 13 months.
12. For seafarer who is currently on board Malaysia flagged-ship, and the Malaysian seafarer serving on board any ship, and his/her seafarer documentation such as Seafarer’s Identity Document, Certificate of Competency, or Certificate of Proficiency has expires during the period of MCO, may apply for an extension until 30th of June 2020. The application is recommended to be made through online system and using the exemption form provided in MSN 09/2019.
13. For foreign seafarer who is currently on board Malaysia flagged-ship and his/her Certificate of Recognition (COR) has expires during the period of MCO, the extension of his/her Certificate of Competency or Certificate of Profiency validity must first be approved by the Flag State of Issuance. The application for an extension period of his/her COR until 30th of June 2020 or any date determined by the Flag State of Issuance is recommended to be made through online system and using the exemption form provided in MSN 09/2019.
Final clearance of crew change is subject to the approval of the PHO/MOH.

Special relief measures

Hutchison Ports Pakistan and Karachi International Container Terminal (KICT) have both announced the extension of free time to 10 days for import containers on vessels that arrived between 20 March and 5 April, inclusive.
They are also waiving of port charges on COVID-19 related medical supplies (ventilators, masks, sanitizers, surgical gloves, medicines, test-kits etc.), and offering free transportation in the city of these goods by their trucking partners. Requests should be made with a letter certifying that the containers contain vital medical supplies to fight COVID-19, issued by either National Disaster Management Authority or the Ministry of Maritime Affairs, for the entire period of the Covid-19 Health Emergency in Pakistan.

COVID-19: additional pilot boarding procedure

Due to the COVID 19 pandemic, additional guidelines must be applied by ships. The Pilot Embarkation Additional Procedure for the embarkation of pilots and subsequent vessel services require the following process:
Immediately prior to pilot embarkation, all surfaces and equipment in the wheelhouse, or on the bridge wings, that the pilot may touch must be cleaned with a suitable cleaning solution.
Once Pilot is on board, no physical contact with Pilot. All crew at the embarkation point must wear a protective mask and rubber gloves.
The crew member assigned to escort the pilot from the embarkation point to the wheelhouse must wear a protective mask and rubber gloves.
A safety distance of 1 metre must be respected between the crew members and the Pilot.
Where possible, the route from the embarkation point to the wheelhouse should via the open deck, as opposed to within enclosed spaces. ELEVATOR FORBIDDEN.
The wheelhouse, where possible, should remain well ventilated via the opening of external doors or windows.
The wheelhouse should be cleared of all crew not essential to the navigation of the vessel, and all crew member’s present must wear a protective mask and rubber gloves.
Unless necessary for the safety of the pilot (i.e. during the embarkation process), crew or vessel, the pilot and crew should remain at least 2 metres apart.
Similar precautions must be taken during disembarkation of the pilot either ashore or to the pilot launch.

Suspension of activities at maritime sector workplace premises to reduce COVID-19 transmission

On 3 April 2020, the Singapore Ministry of Health (MOH) issued a media release on “Additional Measures to Minimise Further Spread of COVID-19”. All business, social, or other activities that cannot be conducted through telecommuting from home will be suspended from 7 April 2020 to 4 May 2020 (inclusive); Essential Services and their related supply chains, as well as entities that form a part of the global supply chain, are exempted from the suspension.
As maritime is a key economic sector and the Port of Singapore is critical in ensuring the flow of goods, it will remain open for cargo operations and will continue to provide essential marine services including bunkering, ship stores and ship supplies.
Maritime-related activities will be exempted from the suspension, including:
a. Shipping e.g. ship operators and liner operators
b. Shipping-related services e.g. ship management and ship agencies
c. Safety and navigation services e.g. class societies, pilotage, salvage and towage
d. Port and terminal operations including construction
e. Port marine services e.g. ship chandlers, bunkering, ferry services
For maritime-related entities which are exempted, you will receive a confirmation email of the exemption from MPA by 3 April 2200H. Entities can also check their exemption status at www.mpa.gov.sg/es_enquiry from 3 April 2200H onwards.
Entities which wish to be exempted from the suspension should first refer to the guidance and FAQs provided by Ministry of Trade and Industry (MTI) at covid.gobusiness.gov.sg before submitting an application. Only entities performing or providing critical support for essential services will be exempted.
For companies that provide maritime-related essential services as listed in paragraph 3, the following guidelines apply:
a) Entities that can continue to operate their business activities (in limited or full capacity) with their employees working from home must continue to do so.
b) For the rest of the employees who cannot work through telecommuting, employers must implement safe distancing measures to reduce physical interactions by:
– Reducing the need for and duration of physical interactions;
– Staggering working hours;
– Postponing all group events; and
– Implementing shift work and/or split team arrangements.
c) Entities are required to submit details of their plans to operate with enhanced safe distancing measures in place at covid.gobusiness.gov.sg by 13 April 2020. MPA also requires you to submit your manpower plans to www.mpa.gov.sg/es_submit by 13 April 2020.
We expect these measures to be in place until 4 May 2020, but this may be extended if necessary. Non-compliance of these measures is an offence under the Infectious Diseases Act. Penalties for non-compliance include a fine of up to S$10,000 or imprisonment of up to six months or both. In addition, existing powers under the Infectious Diseases Act, including the temporary suspension of operations, may be used against persons and operators who do not comply with the Regulations.
Social responsibility is critical in slowing the transmission of the virus. We urge everyone to play their part in the fight against COVID-19. Those who are unwell, even with mild flu-like symptoms, should see a doctor and stay at home to prevent any potential transmission of illness to others.
