Ninety days ago, COVID 19 wasn’t something anyone had ever heard of. Now, it has shut down social life and economies all over the world, and, in most of the United States. American policy holder attorneys have taken aim at insurance companies to make them pay for COVID business income and other claims –in some cases arguably regardless of what the policy language actually says.

Our speakers at this market briefing will analyze how COVID claims are being presented under both property and liability policies and how policyholders are looking to press those claims for coverage. In looking at these issues, legislative and public policy concerns and suggested insurance responses will also be highlighted – all in anticipation of the eventual litigation.

Robert J. Cosgrove, a former prosecutor, is the co-managing partner of Wade Clark Mulcahy, a regional US firm with offices in New York, New Jersey and Pennsylvania. A Thomson Reuters selected “Super Lawyer” in Insurance Coverage, Bob has been working in the London market since 2004 and has experience in handling a wide range of claims and litigation ranging from first party product contamination claims to product liability defense. He has tried cases and argued appeals throughout the East Coast of the United States and has also engaged in arbitrations in the US and the International Court of Commerce.

André C. Gaudin, an AV rated lawyer, is a partner at Burglass Tankersley, LLP. André is a marine lawyer by training who regularly counsels foreign and surplus line insurers regarding litigated matters. He has significant experience in commercial, premises liability, insurance coverage, medical malpractice and insurance related litigation. André has also tried cases throughout Louisiana and the deep South. Burglass Tankersley, LLP has offices in Louisiana and Mississippi.

Joseph D. Zolopsky, is a partner at Glast, Phillips & Murray.
