The perils and pitfalls of delivering cargo without production of the original Bill of Lading: claims by banks and letters of indemnity.

Introduction

This seminar will discuss the pitfalls experienced by carriers when delivering cargo without production of the original Bill of Lading and whether electronic Bills of Lading provide the solution – a commercial perspective.

Specific issues to be discussed will include:

• Delivery of cargo without production of the Bill of Lading – the legal implications and Club cover (P&I and FD&D/Defence)
• LOI “do’s and don’t’s”
• Electronic Bills of Lading: BIMCO’s initiatives, a cargo trader’s perspective and the Law Commission’s proposed reforms to recognise eBills
