Invitation to LSLC’s event – Third Party Funding in International Commercial Arbitration and Litigation – 27th January

Important issues to be discussed:  

1. historical overview of funding including Arkin v Borchard and culminating with the SC decision in PACCAR and government plans to reverse its effect;
2. LMAA arbitrations where P&I Clubs largely cover the funding terrain; 
3. practical considerations – including how a decision to fund is made, enforcement considerations and other factors which potentially affect whether a funder will agree to provide funding;
4. the duty of disclosure of 3rd party funding in court proceedings and compare/contrast international commercial arbitrations, involvement of the funder in the conduct of the arbitration/litigation and exposure of funders to adverse costs order;
